Are Radiology Errors That Lead To Delayed Diagnoses on the Rise?

When patients undergo an imaging test — such as an X-ray, CT scan, MRI, or mammogram — they rely on radiologists to correctly interpret the results. An accurate reading can mean the difference between early detection and a life-threatening delay in treatment.

"Unfortunately, radiology mistakes are more common than many people realize," said Attorney Krysia Syska, "and when they involve serious conditions such as cancer, the consequences can be devastating."

One study shows that radiological errors and discrepancies occur in about 3–5% of cases. (1) While not every mistake leads to harm, research shows that nearly every radiologist will miss or misinterpret something during their career. A missed tumor on a mammogram, a lung nodule overlooked on a CT scan, or an abnormality in the abdomen that goes unrecognized can all result in a delayed diagnosis. For cancer patients, this can mean the disease progresses to a more advanced and less treatable stage.

Why do radiology mistakes happen?

The most common causes for mistakes in radiology include fatigue, excessive workloads, communication failures, or simple misinterpretation of subtle findings (2). Whatever the cause, patients suffer the consequences — and many times, these errors could have been prevented.

Legal accountability for diagnostic errors

When a radiology error leads to a delayed or missed diagnosis of cancer or another serious illness, patients and families may be entitled to seek compensation by filing a medical malpractice claim to hold healthcare providers accountable and help cover the costs of additional treatment, lost income, and the pain caused by a worsened prognosis.

Reports show that when radiology diagnostic errors do occur, a high percentage lead to serious harm (permanent injury or death), and the average payouts (especially in outpatient settings) are large. (3)

In just the first three quarters of 2025, Lubin & Meyer has secured eight settlements of $1 million or more related to radiology mistakes. Specifically,

Attorney William Thompson Featured in Boston Globe Spotlight Investigation of Dr. Derrick Todd

Boston Globe Spotlight Investigation

The Boston Globe Spotlight Team published on October 2, 2025 an in depth report with patient details and timelines of the alleged abuse by the former Boston rheumatologist. Close to 250 former patients — women and men — accuse Todd of sexual abuse under the guise of necessary breast and pelvic exams.

Attorney William Thompson leads the Lubin & Meyer team that represents more than 200 patients. On October 11, 2023, Thompson filed a class action lawsuit that consolidated many of the cases against Todd.

In the Globe report Thompson states:
“There were many people working closely with him, overseeing and supervising him, and there were red flags. There are layers and layers of bureaucracy at each hospital, and yet it seems those in positions to stop him were asleep at the wheel.”
The rheumatologist saw patients at three facilities: Brigham & Women's Hospital, Brigham and Women's Faulkner Hospital, and Charles River Medical Associates in Framingham. The Globe exposed that patients claim Todd's abuse happened even after investigations into his actions were underway.

The article points a finger at the Board of Registration of Medicine for not acting more quickly and for not immediately suspending his license when he was put on leave by the Brigham.

The Globe writes: "The civil suits name as co-defendants more than two dozen medical professionals who allegedly knew or should have known about Todd. The Spotlight Team reached out to every co-defendant who allegedly received a report about Todd."

Said Thompson, “To contend that no one at these hospitals had any idea what he was doing is preposterous and illogical.”
